PART B :  TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before using the website or placing an order. Use of the website or placing of an order constitutes acceptance of these Terms.

T1.  Merchant Information

T2.  Additional Definitions

•  Website: means [https://wasbkk.wecre8te.com/] including any associated mobile application.

•  Products/Services: means all goods and/or services sold through the Website.

•  User: means any person who accesses or uses the Website.

•  Customer: means a User who places an order for Products or Services.

•  Contract: means the contract of sale between the Company and the Customer, formed when the Company confirms an order.

T3.  Registration and User Account

T3.1  User Eligibility

Users must be at least 20 years of age, or 18 years of age with parental consent. Corporate Users must be duly authorized.

T3.2  User Responsibilities

•  Maintain the confidentiality of username and password.

•  Notify the Company immediately of any unauthorized account access.

•  Be responsible for all activities occurring under their account.

•  Provide accurate, complete, and up-to-date information.

T4.  Orders and Contract Formation

The order process and contract formation are governed by the Electronic Transactions Act B.E. 2544, and the Civil and Commercial Code provisions on contractual offer and acceptance.

The Company reserves the right to reject or cancel orders in cases of stock unavailability, pricing errors, or reasonable suspicion of fraud.

T5.  Prices, Taxes and Payment

T5.1  Product Pricing

All product prices are displayed in Thai Baht (THB) and inclusive of 7% VAT unless otherwise stated.

T5.2  Payment Methods

The Company accepts payment via the following channels:  

•  Credit/Debit Cards (Visa, Mastercard, American Express).

•  Bank Transfer (Internet Banking / PromptPay).

•  Approved e-Wallets in accordance with the Payment Systems Act B.E. 2560.

•  Gift cards or store credit (subject to applicable terms).

T5.3  Payment Security

All payment transactions are processed through PCI DSS-certified systems. The Company does not store unencrypted card data.

T6.  Delivery and Shipping

• The Company delivers within Thailand and to certain countries as specified on the Shipping Information page.  

•  Estimated delivery times are shown on product pages but are not guaranteed delivery dates.

•  Risk in goods passes to the Customer upon delivery to the address specified.

•  Title to goods passes to the Customer upon full payment.

T7.  Returns and Refunds Policy

T7.1  Return Rights

Customers have the right to return Products within 7 days of receipt in the following circumstances, in accordance with the Consumer Protection Act B.E. 2522:

•  Products that are defective or not as advertised.

•  Wrong item or incorrect size/specification due to Company error.

•  Products damaged during transit.

T7.2  Return Process

•  Contact customer service within the specified period, attaching photographs of the defective product.

•  Obtain a Return Merchandise Authorisation (RMA) number from the Company.

•  Return the product in original packaging with RMA number attached.

•  The Company will inspect and notify the outcome within 14 days.

T7.3  Refunds

Once approved, refunds will be processed within 14 business days via the Customer's original payment method, unless otherwise agreed.

T8.  Intellectual Property

• All content on the Website, including but not limited to text, graphics, logos, photographs, software, and design, is the property of the Company or its licensors and is protected by the Copyright Act B.E. 2537, the Trademark Act B.E. 2534, and related patent rights.

•  Users may not reproduce, adapt, publish, or commercially exploit any content without the Company's prior written permission.

T9.  Limitation of Liability

To the maximum extent permitted by Thai law, the Company shall not be liable for:

•  Indirect, consequential, or punitive damages.

•  Loss of profits, business opportunity, or data.

•  Damage caused by the acts or omissions of third parties.

•  Damage arising from force majeure under the Civil and Commercial Code.

•  The Company's total liability to any Customer for any claim shall not exceed the value of the relevant order.

T10.  Indemnification

Users agree to indemnify and hold the Company harmless from any claims, damages, or expenses, including reasonable legal fees, arising from breach of these Terms, misuse of the Website, or infringement of third-party rights.

T11.  Dispute Resolution

T11.1  Negotiation and Mediation

The parties agree to negotiate in good faith to resolve disputes within 30 days before commencing other proceedings.

T11.2  Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Thai law. Disputes not resolved by negotiation or mediation shall be subject to the jurisdiction of the competent Thai courts.

T12.  Prohibited User Conduct

Users are prohibited from:

•  Using the Website for illegal purposes or in violation of applicable Thai or international law.

•  Posting or transmitting content that is false, defamatory, obscene, or harmful.

•  Attempting unauthorized access to Company systems or data, contrary to the Computer Crime Act B.E. 2560.

• Automated bulk data extraction (scraping) or interference with Website functionality.  

•  Impersonating others or using another person's personal data without authorisation.

T13.  Account Termination and Suspension

The Company reserves the right to immediately suspend or terminate a User's account without notice if the User breaches these Terms, engages in fraudulent activity, or acts in a manner that may cause harm to the Company or others.

Users may terminate their account at any time by contacting customer service. Termination shall not affect existing Contracts or outstanding obligations.

T15.  Third-Party Links

The Website may contain links to third-party websites. The Company has no control over and accepts no responsibility for the content, privacy policies, or practices of those third-party sites. Access to third-party websites is at the User's own risk.

T16.  Force Majeure

The Company shall not be liable for delays or failure in performance resulting from events beyond reasonable control, including but not limited to natural disasters, pandemics, armed conflict, strikes, government restrictions, or telecommunications failures, in accordance with the Civil and Commercial Code.

T17.  Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
